St. Louis Drunk Driving Accidents

St. Louis Drunk Driving Accident Lawyer

A drunk driver who gets behind the wheel of a car or truck is not only committing a crime, he or she is putting the health and lives of other innocent motorists at risk. Mothers Against Drunk Driving (MADD) reports that approximately every fifty three minutes someone is killed because of a drunk driver, and every 90 seconds someone suffers a non-fatal injury for the same reason.

Drunk driving injuries and deaths come from repeat offenders 33% of the time, and 67% from first time offenders. For repeat offenders, the current criminal penalties of taking away driving privileges and ignition interlock devices, do not seem to be working. The current civil system allows those injured and the families of those killed to seek monetary reimbursement for their harms and losses. This is a 100% preventable crime and the fact that it is on the rise is unacceptable.

Missouri Drunk Driving Laws

According to recent year long study by Missouri State Highway Patrol’s Statistical Analysis Center, 262 people died and over 4,500 people were injured in crashes that involved alcohol throughout Missouri.

In Missouri, the legal blood alcohol limits vary depending on whether the driver under the age of 21 or a commercial driver.

  • An adult driver 21 or older who has a blood alcohol level of .08% may be charged with driving while intoxicated or alcohol-related charges.
  • A commercial driver, such as a bus or truck driver, who has a blood alcohol level of .04% may be charged with driving while intoxicated or alchohol-related charges.
  • A driver under 21 who has a blood alcohol level of .02% may face an alcohol-related charge.

A driver with an excessive blood alcohol level not only faces driving while intoxicated or driving under the influence charges, the license of the drunk driver may also be suspended or revoked.

The Mothers Against Drunk Drivers also reports that in a recent year long study, drunk driving fatalities represented 1/3 of total traffic deaths in the state. MADD also estimates that Taxpayers subsidized over $1.29 billion dollars due to drunk driving fatalities.

Drunk Driving Accident Lawsuits

In addition to criminal charges and license revocations, a drunk driver who hurts another is liable for money damages to the injured victim. Money damages are obtained by hiring a personal injury lawyer and seeking reimbursement from the drunk drivers insurance company. Civil juries often provide extremely high drunk driving verdicts due to the preventable nature of the crime. Drunk driving is a choice, and if that choice hurts or kills another, do not expect the local community to take it lightly.

In Missouri, an impaired individual driving under the influence who hurts or kills another may be required to compensate the victim for:

  • Medical bills incurred as a result of the accident
  • Medical bills that may be incurred in the future as a result of the injury
  • Wages lost as a result of the accident
  • Property damage caused by the crash or collision
  • Numerous other out of pocket and accident related expenses
  • Funeral Expenses
  • Future income

In some cases, establishments such as restaurants, bars and taverns that served alcohol may be liable to the drunk driver’s victim or the victim’s family for damages pursuant to Missouri’s dram shop laws. Missouri law requires businesses that offer alcohol to refrain from serving visibly drunk patrons or people under the age of 21. (Section 537.053 RSMo. (2009))
