What Happens When There is Not Enough Insurance
When numerous individuals are injured in a crash, a common problem results when there is not enough insurance available to cover all the injuries sustained. Insurance policies are commonly written as follows: $25,000/$50,000 or $50,000/$100,000, or $100,000/$300,000. When an insurance policy is written in this matter, it means that the first number is the maximum amount of insurance any one person may receive for their injuries, and the second is the maximum all occupants of the vehicles may receive for their injuries.
In a case where four people are injured and the policy is written as $50,000/$100,000, this means that while not one person may receive more that $50,000 of available insurance, all victims must fight over a total of $100,000. This is an unfortunate real world scenario which happens far too often in underinsured driver accidents. However, injury victims still have options.
Injury victims need to make sure the amount they are told is the maximum is actually the maximum. Insurance companies often try to hide coverage or ‘forget’ to tell the injured party that there is also an umbrella policy which applies to the claim. Umbrella polices can drastically increase the amount of coverage available. In addition, insurance companies try to hide the fact that certain policies may be stacked on top of each other to provide additional coverage under Missouri law. It is important you consult with an injury lawyer who is able to make sure money is not being left on the table.
Do I have Underinsured Coverage Which Will Apply?
When the other party does not have enough insurance coverage to cover your injuries, your insurance policy on one of your own vehicles may have additional benefits. You may have what is called ‘underinsured motorist’ coverage (UIM). UIM coverage is only applicable if you exhaust the at-fault parties available benefits. In addition, your insurance policy has several requirements you must closely follow in order to collect your UIM benefits.
If you fail to perform all of the required UIM conditions, your insurance company will deny your UIM claim. You must be extremely careful to protect your case. An experienced car accident lawyer will make sure you perform all obligations in order to receive the maximum amount available.
Benefits of Hiring an Accident Lawyer
As stated above, your accident lawyer will make sure you are not leaving insurance coverage behind. They will also make sure your UIM benefits are protected. In addition, an accident lawyer can help drastically reduce your medical expenses in order to put as much money in your pocket as possible. You should also ask your lawyer about ‘medical payments coverage’.
