Jefferson County Wrongful Death and Accident Claims

Following a tragic car accident, all parties are trying to make sense of what happened. While parties are receiving treatment, it adds insult to injury when insurance companies start calling trying to obtain a recorded statement. You should be advised that you do NOT need to speak to the insurance company until you are ready. By not speaking to them, you are not hurting your case at all. While you do have a limited time frame to bring a claim for personal injuries in Missouri, you have 5 years to file a personal injury claim, and 2 years to file suit for wrongful death.

After you have had a chance to receive initial medical treatment and grieve your loss, you will begin to think about the process required to seek reimbursement for your harms and losses. Danielle Cole, who was injured in this crash, will need to file a personal injury claim against Mr. Werner’s insurance company. In addition, the family of Mr. Bryant will need to begin the process of making a wrongful death claim with┬áthe same company. According to the Missouri State Highway Patrol, it is not yet known whether Mr. Werner had liability insurance on his vehicle.

It is imperative a proper investigation is conducted into all aspects of the crash. In a case such as this, the first question is: Where can I get a copy of the police report? A copy of the basic report can be found online at the MSHP’s website. However, there will also be a much more detailed car accident report created by the State of Missouri. In serious injury and death cases, these reports can take 30-90 days before they are released to the public.

Do I Need a Personal Injury Lawyer?

In a case of this nature, an injury lawyer will offer many advantages. First, your attorney will make sure a proper investigation occurs into all relevant facts of the case. You lawyer will obtain all insurance information and make sure the insurance company is not hiding any liability coverage which may be available to provide reimbursement for your losses. In addition, if there is underinsured motorist coverage (UIM) available, you will need to be absolutely sure that you do not sign anything which will jeopardize your ability to access your UIM coverage. An injury lawyer will also help reduce your medical bills and prepare all documents required to have a wrongful death settlement approved by the court as required by Missouri Law.

These serious injury and wrongful death cases have many aspects which need to be dealt with properly. These large insurance companies make billions of dollars each year through the denial of valid claims. This often occurs as the result of someone simply not being familiar with how the policy works. Your insurance policy is a contract, and it you do not follow all the terms of the contract, you may not be able to receive the benefits available. We all know that no one reads their entire insurance policy.
